In New York State, the most frequently issued traffic ticket is for a violation of VTL §1180 (d). This statute is the default speeding ticket violation. The statute does not change for higher speeds or lower speeds. However, the fine will change depending on the miles per hour over the limit. See DMV website for points breakdown. The fines are ultimately up to the judge and the maximum also changes based on how much over the speed limit the ticket charges. It usually ends up in the range of hundreds of dollars. A high-point violation or multiple violations will trigger an additional Driver Responsibility Assessment Fee of – minimum - three hundred dollars. This applies equally to New York State, out-of-state, and some Canadian motorists. Typically, the most costly consequence of a speeding violation on your record is the increased car insurance rates.
In New York State, it is difficult for a motorist to win a speeding ticket case unless it is handled properly. Simply disputing the officer’s allegations typically leads nowhere, even if the officer is lying. Who do you think the prosecutor and judge will believe? Furthermore, there is little documentary evidence that the officer needs to produce to make a speeding case. The officer does not need to produce a “print-out” of the radar or laser reading. Finally, officers are trained to visually estimate the speed of vehicles. So even if the technical readings are not accepted by the court, the officer can always rely on their visual estimate to establish a proper case.
The good news is that if handled properly, the speeding charge can be reduced dramatically or dismissed entirely. There are several legal and procedural tactics that can be utilized to fight off the charges. Your best bet is to hand off the case to a law firm that is dedicated to traffic ticket defense. In New York State, your attorney can go to court instead of you. Furthermore, there is no need to present an actual defense or any evidence to fight your ticket. You can let your attorney handle everything.

How can I get my speeding fine reduced in court? The cop ticketed me at 50 in a 30 but the right before he caught me the road took a rapid decline causing the car to increase speed rapidly, is that enough basis to get the fine reduced?
What should I do in this situation? Plead guilty or not guilty? I was pulled over and given a ticket for speeding. 53 in a 30mph zone. I was in an unfamiliar area in the middle of the night heading back home with my newborn screaming in the back. Drove through the majority of the village at 30mph and shortly before the 55mph zone actually began, my google maps changed to show the current speed limit as 55. I had looked back to check on my baby for a split second and assumed the village limit had ended because google maps speed limit had raised and we were on the outskirts of the village that becomes open fields. So I began speeding up, and then saw a sign ahead that said "end village speed limit" and immediately began slowing down. As soon as I hit my brakes a cop pulled out from the side of the road and pulled me over. I'm unsure of what to do. I've never gotten a ticket in my life and have no idea how any of this works or what to expect. Do I plead guilty? Not guilty? What are the consequences? Is jail time likely? When I tried to look up the fees they were listed but it also said 15-30 days jail time is possible. I'm scared of the outcome and court is in a couple of weeks.
Not going to jail but best if you plead Not Guilty. That way you can avoid the points and increased insurance rates. An attorney can submit the not guilty plea for you and make any necessary court appearances in your place.
Should I proceed with emailing the DA as advised by the court, to reduce the violation penalty and apologize? Was ticketed months ago, 2 charges, speeding 106 in a 65 driving through Dewitt, New York. My first speeding ticket out of state(MA) and close to 5 years. It was 3-4AM and I was driving from Ohio to Massachusetts in a Red Rental car. I would like to if possible avoid the 11 point hit on my driving record.
You can get suspended in NY even with a MA license. Need to tread carefully.
Speeding ticket appeal problem? A few months ago, after my NYC court date had been postponed for about five years, the court found me guilty and put 4 points on my license. I was never told why I was found guilty, who the judge was, or what I needed to do to appeal or where to file it. I spent days trying to track down the decision, the fine information, and the appeal process myself. I had submitted several defenses in my written statement, the SIOPA, but I still have no idea why they were ignored. Then my appeal was denied too. I explained that I had to do the DMV's job just to get the basic information about the ruling and asked for some consideration because of all the time it took. I did not pay the $40 fee to have the hearing's electronic record sent to a separate office in Arizona. The appeals board left the Bronx judge's decision in place, and my insurance increased by another $600. Is there anything I can do?
The next step would be to file an Article 78 petition in Supreme Court, but that is more expensive and has low odds of success. Sorry it may have been a good idea to have an attorney involved from day one.
My 18-year-old son got his first speeding ticket on the Cross Island Parkway. The officer says radar showed him doing 75 in a 50. Is it worth hiring a lawyer to contest it, and is there any possibility of reducing the points?
Yes there is. An attorney can go to court in his place and should be able to at least get some points off. The ticket is probably returnable to the Queens Traffic Violations Bureau.

Maybe but a four point speeding ticket will be far costlier to your insurance than the fine, whether reduced or not reduced. There are ways of avoiding the points and the high fines. An attorney can help and can make any necessary court appearances in your place.
