A client of our hired us to represent them in the Lindley Town Court (Steuben County) for a VTL §402(1)(b)(i) violation — a dirty or unreadable license plate (ticket S250035422). They also received a companion traffic ticket (S250035423). Our founding attorney, Benjamin Goldman, Esq., submitted a plea of not guilty on their behalf and requested supporting depositions on February 11, 2025. Our client completed the traffic diversion program. The People then moved to dismiss the tickets. A certificate of disposition dated December 20, 2025 confirms the dismissal — no points and no fine.
In a May 7, 2025 letter to the Lindley Town Court clerk, our office noted that “The People Moved to Dismiss the ticket after our client completed the diversion program.” The matter had not been resolved on the record in open court, which is why we sought written confirmation and later obtained a certificate of disposition. This was not a trial on whether the plate was dirty or covered on the merits — it was a dismissal following diversion program completion and the prosecution’s dismissal motion. For contrast with a procedural speedy-trial dismissal in another plate case, see our Union Town Court VTL §402 dismissal under CPL §30.30.
Dirty-plate and plate-cover tickets in New York justice courts are not always fought to trial. Some courts and prosecutors offer a traffic diversion program — complete the program, and the People may move to dismiss. That path can leave our client with no points and no fine even when the underlying facts look unfavorable. An experienced traffic attorney knows which courts offer diversion, how to preserve supporting-deposition and speedy-trial rights while pursuing it, and when to press for written confirmation that the case is truly closed.
