Vehicle & Traffic Law § 1111(a)2, Failed to Yield Green Arrow

If you received this ticket for this violation, it means that a police officer alleges that you did not yield to traffic that has the right-of-way due to a green arrow light. This is an infrequently issued ticket in New York State because (1) the circumstances are unique and (2) other statutes can be utilized for the same circumstances, including Vehicle & Traffic Law ("VTL") § 1140-a, “Failed to Yield Right of Way at Intersection”.

How Much Is a VTL § 1111(a)2 Failed to Yield Green Arrow Ticket in NY?

  • Fine and surcharge: Up to $150, plus a mandatory $93 surcharge ($88 in city courts) for a first-time offense. The exact amount is up to the Judge's discretion.
  • Points: A conviction carries 3 points on your New York driver's license.
  • Insurance impact: With this violation appearing on your driving record, you can expect to see increased insurance rates for the subsequent 3-4 years.

VTL § 1111(a)2 — Statute

The language of the statute is as follows:

§ 1111. Traffic-control signal indications. (a) 2. Traffic, except pedestrians, facing a steady green arrow signal may cautiously enter the intersection only to make the movement indicated by such arrow, or such other movement as is permitted by other indications shown at the same time, except that a U-Turn may be made by traffic facing a left green arrow signal unless a sign prohibits such U-Turn or such U-Turn is in violation of any other provision of law. Such traffic shall yield the right of way to other traffic lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited.

Fighting a VTL § 1111(a)2 Ticket

Like most other traffic tickets, a defendant or their attorney can fight the charges. Whether the allegations are true, partially true, or entirely untrue does not really play a role in the adjudication. Success in challenging traffic charges rarely involves convincing the judge of your version of the events. Without solid evidence such as dash-cam footage, the judge will in all likelihood accept the officer’s version of the events over the motorist’s version of events. The best way to fight a traffic ticket is by finding issues, whether legal or factual, whether an omission or a contradiction, with the charging instruments. Also, a prima facie case would require that all paperwork be completed and filed properly. CPL 245 allows for many discovery rights. This is where an experienced traffic ticket lawyer comes into play. Your attorney can utilize various technical and procedural tactics to fight the charges. An experienced traffic attorney should be able to get the violation reduced to a no-point ticket or dismissed entirely.
