Our client faced five unanswered tickets in the Wilton Town Court (Saratoga County), including a VTL §402.1 plate violation, an eleven-point speeding charge under VTL §1180, and misdemeanor counts. They had been suspended for failing to answer the tickets. Benjamin Goldman, Esq., entered on December 26, 2024, pleaded not guilty, and sought a suspension lift under the Driver’s License Suspension Reform Act. Our client completed a defensive driving course. After plea negotiations with the Saratoga County District Attorney’s Office, the parties executed a Trial Waiver and Plea Agreement in May 2025 resolving all original charges in full satisfaction. The August 12, 2025 fine notice shows the VTL §402.1 plate violation, reckless-driving count, and aggravated unlicensed-operation charge marked dismissed/covered, with fines imposed only on the remaining speeding and unlicensed-driver counts (total due $743.00).
The original charge stack included VTL §1212 reckless driving (five points, misdemeanor), VTL §511.01(a) aggravated unlicensed operation (misdemeanor), VTL §509.1 (unlicensed driver), VTL §402.1 (plate/display), and VTL §1180 speeding. Under the signed Trial Waiver and Plea Agreement, our client pleaded guilty in full satisfaction of those charges. The case was not tried on the merits of whether the plate was missing, insecure, or dirty. Instead, the global plea dismissed or covered the plate ticket, reckless-driving misdemeanor, and aggravated unlicensed-operation count — eliminating the most serious charges in the stack. Fines were imposed on the remaining speeding and unlicensed-driver violations only. For other ways plate tickets can be beaten, see our Lindley Town Court diversion dismissal and Union Town Court CPL §30.30 dismissal.
Unanswered tickets do not go away — they can trigger a suspension that makes everything worse. Here, our client had old Wilton tickets spanning plate, speeding, and misdemeanor charges. The path to resolution was not a single-issue trial on the §402 plate count. It was lifting the suspension, completing defensive driving, negotiating with the DA by mail, and securing a global plea that dismissed or covered the plate ticket, reckless driving, and aggravated unlicensed operation — while leaving fines only on the less serious remaining counts. Plate violations are often one part of a larger case; an experienced traffic attorney looks at the whole stack, not just the headline charge.
