The Benjamin Goldman Law Office has handled thousands of 1180(b) tickets. Our firm has had much success in obtaining dramatic reductions for many of our clients. This is done mostly by entering into plea bargain negotiations that result in a substantial modification of the charges. Advantageous plea bargains are not obtained by convincing the judge or prosecutor of your version of events. This rarely works. There are various legal techniques and procedural tactics that good traffic lawyers utilize to obtain highly advantageous reductions.
The Benjamin Goldman Law Office is dedicated to helping motorists with speeding tickets. We have helped thousands of clients avoid the costly consequences of a serious speeding violation appearing on their driving record. Our firm takes on cases all across New York State, from Valley Stream in Long Island to Amherst, outside of Buffalo. We will be glad to review your speeding charges and let you know what we can do for you. Consultations are always free.
If you are cited with speeding on a road in New York State with a 55 MPH speed limit, you will be charged with Vehicle & Traffic Law § 1180(b). The fine and points vary, depending on how much over the speed limit you are charged with going.
The exact wording of the relevant sub-statute is:
(b) Except as provided in subdivision (g) of this section and except when a special hazard exists that requires lower speed for compliance with subdivision (a) of this section or when maximum speed limits have been established as hereinafter authorized, no person shall drive a vehicle at a speed in excess of fifty-five miles per hour.
1180(b) is the second most “popular” speeding ticket in New York State. The first is 1180(d). More tickets for 1180(d) are issued than 1180(b) because 1180(d) applies to all speed limits and 1180(b) applies only to 55 mph speed limits. It is unknown why there is a separate subsection for 55 mph zone roads. For all practical purposes, 1180(b) is the same as 1180(d). The fines and possible points are the same.
In New York City, the default speed limit is 25 mph. Outside of the city, the default speed limit is 55 mph. Interstate highways in New York State have a default speed limit of 65 miles per hour. There are some portions where the speed limit on the highways is reduced to 55 mph. The speed limit on parkways never exceeds 55 mph.
The points depend on how much over the limit you are charged with going. See DMV link for points breakdown. The judge does not have the discretion to reduce the points if you plead guilty. The points are automatically associated to your record once you plead guilty.
Unlike the points, the fines are determined by the judge. For speeds 10 mph over the limit or less the maximum fine is $150 + $93 surcharge. For speeds between 11 and 30 mph over the limit the maximum fine is $300 + 93 surcharge. For speeds more than 31 mph over the limit the maximum fine is $600 + 93 surcharge.
Once you reach six points in eighteen months, there will also be Driver Responsibility Assessment Fees. This has to be paid whether you are a New York or an out-of-state driver. A judge does not have the discretion to waive this fee.
The largest cost is often the increased insurance rates. When you renew your insurance, they check your driving record. With a speeding violation appearing on your record, you can expect to be quoted significantly higher premiums for several years after the conviction date.

I just got a Gen101 speeding ticket. going 88 in a 55 i was wondering how many points it will be and how much it will be ? I had my cruise control on others were going faster than me. it was late (2am and i was just trying to get home. he stopped me and said i was going alittle fast and now im just trying to figure out the damage.
What should I do w this traffic ticket in Suffolk Cnty that was 25 over (80 in 55mph); i've done some research, no points deal? Was pulled over by a New York State trooper this morning for going 25 miles an hour over the speed limit 80 in a 55. I live mainly out of my car and was going to my mandated appointment that I was late for at the state employment center. I know that carries 6 points which would be a $300 state DMV assessment fee also plus the insurance hike. From what I've read it seems like my best option is to send back the ticket with my not guilty plea and show up in traffic court on my date and plead down to get a fine with 0 points. is this the best option? it would definitely cost me less overall to pay a higher fine now but I get no points and not have my insurance go up and not get a DMV fee. That seems to be a common deal in my county I guess. I'm thinking I could take care of this process myself since I don't have a stream of income, but are there low income helping legal services in NY for traffic tickets, not sure pro bono for something like traffic but not sure of all my options out there. I had a dwi 7 years ago. Thanks.
traffic tickets are not eligible the legal aid or public defender because they are non-criminal in nature
What do you recommend doing with my speed ticket? I live in Toronto, and I was on my way to come back home in Buffalo Hwy290. A police officer pulled me over for speeding two days ago. He told me that I drove 75mil/hr in the area with maximum speed of 55. Consequently, I have to attend to the court (TONAWANDA TOWN COURT) in Buffalo or send them a mail about that. I have never been in this situation and Also, I have never had any speeding ticket. Thank you
The violation will transfer to Ontario. A New York traffic ticket attorney can handle all. You should consider getting in touch with one.
I was just notified to appear for a speeding ticket from over two years ago. Is that valid? I was given a ticket during Covid for 78 in a 55. I showed up to court on the date I was supposed to, they had everyone there just drop the papers in a box (it was during Covid) and leave. More than 2 years later I receive a letter telling me to show up to town court for a ‘conference’. Is this still valid?
The ticket should be dismissed on speedy trial grounds.
What can do to fight a 41 mph+ speeding ticket and what are my odds I won’t get my license revoked. I was traveling on I87 and a state trooper was hiding under a commercial truck (coke truck) and pulled me over and I was clocked at 96, 55.
suspended, not revoked. Either way there are few different things that can be done to minimize risk of suspension. The first step would be to get an experienced traffic ticket attorney involved.

That would be eight points. Maximum possible fine of $693+ $450 Driver Responsibility Assessment Fee. An attorney can go to court in your place and work on getting that reduced or dismissed.
